Contest Rules: FatZap™ “Perfect Body for Free” Contest

OFFICIAL RULES
You are providing personally identifiable information at the contest registration page. By entering the contest you are agreeing to provide registration information to FatZap™ Centre.
Only one entry per person and/or per e-mail address will be accepted for the duration of the contest
Deadline to enter is 11:59 p.m. 28 February 2007.
False or deceptive entries or acts will render the entrant ineligible.
We RESERVE THE RIGHT TO MODIFY SCHEDULING OF THE CONTEST WITHOUT PRIOR NOTICE. AND RESERVE THE RIGHT TO TERMINATE OR SUSPEND THE CONTEST WITHOUT NOTICE, AT ANY TIME AND FOR ANY REASON.
Eligibility.
Competition is restricted to existing clients of FatZap™ as of 28 February 2007. You are eligible to enter the contest if you are: (1) Australian. CITIZEN OR LEGAL RESIDENT OF Australia AT ALL TIMES DURING THE CONTEST; (2)18-YEARS OLD OR OLDER AT TIME OF ENTRY; (3)NOT AN EMPLOYEE, AGENT, AFFILIATE, OFFICER OR DIRECTOR OF ANY ADVERTISER, PROMOTION AGENCY, FULFILMENT AGENCY for the competitor; (4) NOT A RELATIVE OF AN EMPLOYEE, AGENT, AFFILIATE, OFFICER OR DIRECTOR OF ANY ADVERTISER, PROMOTION AGENCY, FULFILMENT AGENCY; AND (5) – ANY USE OF ELECTRONIC DEVICES TO ENHANCE OR ALTER YOUR ODDS OF WINNING WILL AUTOMATICALLY DISQUALIFY YOU. VOID WHEREVER PROHIBITED BY LAW. CONTEST IS SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. We may require winners to provide proof that they are the authorized account holders of the e-mail addresses used to enter the contest. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet service provider, online service provider, or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the e-mail address. Any winner who does not comply with the Official Rules will be disqualified. Return of any prize or prize notification as “undeliverable” will result in disqualification and an alternate winner may be selected. Ineligible entrants may be disqualified at any time at the sole discretion of FatZap™.
Entry.
BY ENTERING THE CONTEST, PARTICIPANTS UNCONDITIONALLY AGREE TO ACCEPT AND BE BOUND BY ALL TERMS OF THESE OFFICIAL RULES AND THE DECISIONS OF THE FatZap™. To enter the contest: 1) individuals may submit their e-mail address, first name, last name, street address (including city, state, and POST code), phone number, and birth year via the “Enter to Win a $3000 worth of Treatment at FatZap™ plus + $1000 cash” banner. By entering the contest, entrants agree to receive, from time to time, the FatZap™.com.au Update e-mail newsletter. Additionally, if you enter the contest via an “Enter to Win a $1000 cash ” banner, you may receive a contest confirmation e-mail that includes a confirmation link. To complete your contest entry and confirm your agreement to receive the Newsletters, you must click on the contest confirmation link. After confirming your entry, you may, at any time, opt-out of receiving the Newsletters by following the opt-out instructions contained in the Newsletters you receive from time to time throughout the term of the contest,
How to Win.
The Contest winner will be selected in 2 step process. At the first step 20 men and women from all eligible entries received during the dates specified above will be selected by a FatZap™ panel based on three simple criteria:
- Your ability to represent FatZap™ brand and inspire others.
- Your essay describing how FatZap™ treatment along with a healthy eating plan and exercise has improved your self esteem, the way you look and the quality of your life.
- Your overall improved look.
The Contest winner will be randomly chosen by a representative of FatZap™ (the “Judge”) on or about August 15, 2007, from 20 entrants selected in the first step specified above. The decisions of the Judge will be final and binding. The odds of winning will depend on the total number of eligible entries received. The winner will be notified by e-mail or telephone within ten (10) days of the drawing and must meet all eligibility requirements including the execution and return of all necessary releases.
Prizes.
a) There will be one Grand Prize for the contest, consisting of a $3000 gift certificate redeemable toward any procedures at FatZap™ Centre plus $1000 cash, awarded to one contest participant. The Grand Prize winner will be chosen randomly from among 20 men and women selected during the first step from all valid entries received during the term of the contest. The Grand Prize will be posted to the Grand Prize winner’s home address. In the event FatZap™ is unable to send the Grand Prize directly to Grand Prize winner’s home address due to postal restrictions or other circumstances beyond the control of FatZap™, or if the described Grand Prize is otherwise unavailable for any reason whatsoever, FatZap™ reserves the right to substitute a prize of like value. The Grand Prize is not redeemable for cash and is for one time use only. The winner will not be credited any remaining balance for any unused portion of the prize at time of visit. The winner is not entitled to any alternative prizes and the prize is non-transferable
b) Fulfilment of the prize package is restricted to specified dates to be determined. Other restrictions may apply. Any prize or prize certificate not claimed within 1 month of winning will be forfeited by the winner. In the event that a prize or prize certificate is mailed to the winner, winner assumes the risk of its arrival. FatZap™ is not responsible for the safe arrival of a prize or prize certificate.
Construction.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant and FatZap™, shall be governed by, and construed in accordance with the laws of the State of Victoria, without giving effect to any choice of law or conflict of law rules or provisions (whether of Victoria or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than State of Victoria. All claims relating to the contest must be brought in the federal or state courts located in Victoria, which shall have exclusive jurisdiction and venue over such claims. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
(a) FatZap™ is not responsible for technical or computer failures, errors or data loss of any kind, lost or unavailable Internet connections, or failed, incomplete, garbled or deleted computer or network transmissions, which may limit the ability to play or participate in the contest. All entries become property of the FatZap™ and will not be returned.
(b) Participants are eligible to win an FatZap™ contest only once every year. Only one winner per household is permitted in any contest.
(c) Participants are eligible to win a prize valued at $500.00 or more only once every twelve months.
(d) By entering, an entrant agrees to abide by these rules, and warrant and represent that their entry is their original work, and grant to FatZap™ the right to edit, publish, promote and otherwise use their entries without further permission, notice or compensation.
Conditions.
(a) Decisions of FatZap™ with respect to the contest are final.
(b) Payment of all federal, state and local taxes are the sole responsibility of the winner.
(c) By participating in the contest, you agree to have your name, voice, or likeness used in any advertising or broadcasting material relating to this contest and to sign a publicity release, affidavit of eligibility, and release of liability prior to acceptance of the prize. By submitting an entry, you grant FatZap™ and its agents the right to use your name, voice, picture and/or likeness for purposes of advertising and publicity in any and all media now known or hereafter invented, without further permission or additional compensation, except where prohibited by law. By submitting an entry, you grant FatZap™ and its agents the right to record, copy publish, use, edit, exhibit, distribute, perform, merchandise, market, license, adapt and/or modify your entry in any way, in any and all media, without limitation and without compensation. Participants also agree to be contacted by FatZap™ and receive marketing and promotions from FatZap™. Winner, by acceptance of their prizes, agree to release FatZap™, their respective parents and subsidiaries, and their respective advertising, promotion and production agencies from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize or while preparing for, participating in, and/or travelling to any prize-related activity. Void where prohibited by law.
Changes:
FatZap™ reserves the right to make changes to the rules of the contest, which will become effective upon announcement. In the event of a misunderstanding, dispute or human error, FatZap™ management will make the final determination of the prize winner. By entering this contest, contestants agree to be bound by these rules and any FatZap™ management decisions concerning the contest.
The contest is void where prohibited or deemed medically unsafe.
Disqualification
Failure to comply with the contest rules may result in a contestant’s disqualification.
